Peter sent a follow-up message to me...

Hi Ron, as a follow up the CMC is to finalize the Order as noted in the Court's decision and was requested by both DOJ and MC, although we were the ones who wrote the Court, to expedite the execution and issuance. The CMC is Monday, and is a routine matter.

Also I got an email question from a member on the "no costs" awarded line in the decision. That refers to the fact that no order for costs will be made against the unsuccessful party, the GOC. It has nothing to do with our disbursements which were awarded by the Court nor our 8% fee award.

So the final order on fees will be 8% of all retro payments to members (including the offset of debts owed to Sisip) tax gross up and interest, plus applicable provincial taxes/gst/HST. This is all in the memo which was mailed today.

So it looks like there will be no email memo. It is going to be mailed to each person. Which if you stop and think about it not everyone has a computer and this is the way to be informed. Hard copy in your hand and a request to send the information card to MC to confirm your address.

As per Federal Court Clerk this afternoon in response to my quiry ref the recent docket ~ It appears that counsel have requested a brief case management conference (CMC) with Justice Barnes because they need clarification on what the terms of the draft Order that they will be submitting should be. The letter which specifies what they are asking for which appears to be with regard to para. 55 of the Reasons for Order and Order that states: “counsel to make the required changes to the proposed settlement Order to be submitted to the Court for execution and issuance”. I will post a copy of the letter submitted to the Court today once I can figure out how to from a pdf file....Sparrow

sorry still working on the pdf file ~ I am a bird not a computer tech.....hang ten...

Remember MC has stated that they will except what the Judge's decision on the fees. Now as far as para 54 where the Judge states , no award cost, he explains this clearly in para 50. So this might be just be a final step to clarify the order as per para 55, for execution and issuance.

Until MC does that the court can not issue the order. So if MC is questioning "COST" then they have not made the changes and that is why JB has not issued the order yet and why we are not seeing direction being given to SISIP and money being handed over to pay us.

[ affraid b]This is to funny. We are going to send everybody a letter in the mail to confirm your address. What if they have the wrong address to begin with??
