I've withdrawn all and any appeals from VRAB being pushed forward from BPA, I redress two last year with no change in condition or percentage,

From applications in the past they have denied what should have been straight forward applications, and had to appeal them for mistakes made in their (VRAB) interpretation or view,

Nothing is worse than a bureaucracy that is forgets its mandate and chooses to only look at protecting the Treasury Board thru mismanagement of its given task

hy Sparrow, you need a lot of courage and stamina to fight the system, I had the same type of problem with them, in order to prove my case I had to order the copy of my medical files 5 times before I got everything to prove that my medical condition started while serving ( I send a copy of all my visits to the MIR related to my condition) then I send them the report of my pre-enrollment medical indicating that I was healthy. I told them that if I would have those conditions prior to joining why they did not tell me and then recruited me so guess what that time around I won. Your husband accordind to VRAB has the benefits of doubt, they have to prove that he is wrong. So instead of trying to prove the corelation, they have to prove that DND is not responsible. Just send them the facts of before the army, service time and the after. It's a lot easier for you. Good luck and don't let them pull you down. When you Twisted Evil will win, they will have to pay him a lot of backpay.

Thanks everyone, for my spouse, the nuetropenia and cyclic luephoma is next to impossible to link the exposure to toxins to the conditions. We have had specialists tell us no one will make that assertion...it is similar to Depleted Uranium cases ~ my husband had a test done from independant lab in US and 6 years post release he still has countless carcinogeons at the 90-99% range in his blood system...but, no doctor or specialist has the expertise or care factor to put the link on paper even though it is quite obvious basd on career trade, immunization records and overseas tour environment. No one wants to go up against DND or military tribunal...I have done alot of research and contacting specialist and they all say the same thing.

As for my husbands tinnitus ~ he is one of those cases where his hearing loss is minimal but he has tinnitus ~ so DVA choses to discount his exposure, I guess he should be deaf and then the tinnitus may be considered.

Sparrow, sorry to here that. By the sounds of it,VRAB is suggesting getting a specialist to confirm the link, and or cause and effect. I was in a similar circumstance awhile back different condition, where the Lawyer relayed the same thing to me. What I did was contacted my family doctor and made and appointment with him, I brought my denial Letter with me. I simply said to him, is there a way you can make and appointment for me with the specialist, and relay the info from this Letter to him. My doctor did indeed make that appointment for me, when the time came to meet with my specialist, he was very well informed by my doctor about what I wanted. I brought the Letter with me and discussed it with the specialist. It took some time before I got the response back from the specialist, and even longer to get and answer from DVA. For me it worked, I finally got my award from DVA. I am not going to say that it will work for everyone, however it may be something to think about.

Yes, I think for many that reassessments will not get any increase. I am under the 1995 table and under the new table....tho I am more disabled that I was before. VAC says under the new table my assessment would be less. So my reassessment for an increase was denied. I would think I could lose use of my arms and legs completely and they would not increase my assessment.

Sorry, Sparrow, I believe with this grandfathering they aren't even going to reassess anymore. My advice , you and your husband take a nice vacation , cruise something. Sometimes it's nice and relaxing to not always think about vac or sisip, I know it's hard!

Just received yet again a denied decision from the VRAB for my dear husband ~ 20 year Vehicle Tech med released for lower back and rotator cuff ~

The following is his disability applications to DVA and the subsequent decisions:

Chronic Nuetropenia (blood disorder of the  white blood cells called nuetrophils  as well as combined with cyclic lymphona due to exposure to chemical toxins) ~ Denied DVA and Denied by VRAB (he has one more appeal available to him at the VRAB level but advised by VRAB lawyer not likely successful if a doctor won't put in writing the link of cause and effect) ~ note ~ he was diagnosed with this disease post Bosnia  but not the reason he was med released as he was halfway out the door when he was finally diagnosed after 3 years of not being recognized or diagnosed by DND docs that he had virtually no white blood nuetrophils because no one picked up on it. Presently he has .01 nuetrophils where a normal healthy person has 5.0 + and his liver numbers are elevated now..He does not drink...

Tinnitus (20 years around loud vehicle machinery and an incident with a piece of hot metal going into his ear drum) ~ Denided DVA and Denied VRAB (one more appeal available to him but advised by VRAB lawyer not likely successful unless a specialist does not link cause and effect )  

Reassessment for back and rotator cuff recently done as he had not been reassessed for 10 years) ~ Denied increase by DVA

Denied psychological counselling sessions by DVA

I am speechless............sparrow
