Re: SISIP benefit beyond 24 month period..
Email to Harold Leduc
Hey,
Was thinking you might have some info on the ELB/SISIP mess.
As I see it, they abuse the SISIP LTD by using it for the 1st 2 years.
Then they use ELB after SISIP ends.
The right way is to get SISIP in addition to anything else. Like the Pension Act pension + SISIP after the Manuge case. The reason is that you buy SISIP LTD so you get it & you get the pension because you traded the right to sue for the pension.
If they kept the right to sue for the NVC benefits, they have to do the same deal.
SISIP LTD was purchased with premiums, establishing a right to benefits.
NVC benefits are purchased with the right to sue.
Simple, huh.
What prompted this email was the realization that ELB, as a copy of SISIP, has to pay for "own occupation" disability BUT at the moment, SISIP covers ONLY "own occupation." It has a few people getting it after the 2 years BUT ELB avoids the "own occupation" & focuses on the "any occupation" period. The "own occupation" definition is much bigger, 6 times as big. The "any occupation" definition is like Canada Pension Plan Disability (CPPD).
I have a suspicion that VAC wanted to take over SISIP LTD but they probably didn't consider the full implications of the takeover.
I also strongly suspect the NVC was solely designed to get rid of the SISIP + pension problem. Seems obvious:
Disability Award = pension
ELB = SISIP
PIA = EIA

Honestly, I do not know of anyone who has started collecting the RISB. Honestly, I don't know of anyone even close to 65 getting ELB. They sent my father an application, but he had just turned 67. It made me laugh.

If you go to your VAC my account, under your financial benefits, it will say Extended Earnings Loss, and give you an expiry date on or close to your 65th birthday.

Re: SISIP benefit beyond 24 month period..
No, ELB is considered a short term benefit for while you are enrolled in the Rehab program, but if they deem you TPI, the ELB is converted into EELB, which goes until 65

Re: SISIP benefit beyond 24 month period..
Thanks very much, bigrex. I wasn't sure if I should explore both at the same time, this really helps. Now if I could just sleep between 1 and 4 am....

Re: SISIP benefit beyond 24 month period..
Mimsy, my suggestion to you is to submit your appeal for SISIP, and request a determination of TPI from VAC for EELB. There are no rules about exploring both avenues. TPI for VAC is probably easier to get than the SISIP extension, but why pin all your hope on just that.
