Can My CPP Disability be Garnished Empty Can My CPP Disability be Garnished

A question was asked about garnishing CPP Disability. So I phoned CPP and this is the answer I got...

A) If you are in receipt of a CPP Disability Pension here are the only ways your CPP Disability Pension can be garnished...

B) Canada Revenue Agency if you are in arrears for taxes owed.

C) A Family Order Enforcement from a judge if you are not paying child or spousal support.

One other way is a Credit Split in divorce or Common Law separation. Now this can only happen under 2 reasons...

1. you were making contributions to CPP then you are injured and start to receive CPP disability your spouse is entitled to a credit from your contributions.
2. if you started receiving CPP Disability before 1987 your spouse is not entitled to the credit.

Again if you have any specific details you need answered call 1-800277-9914 between 8:30 - 4:30 Monday to Friday.
