Redfisher. I posted a bankruptcy comment for you on another thread. I will repeat it here. You have a choice WHEN you claim your retro. If you choose to claim those pre-bankrutcy years then CCRA automatically sends notice to your trustee, You will owe them the appropriate funds plus any tax rebate you may have coming. By claiming all your retro post bankrutcy years CCRA will not send the trustee any notice and you will be able to keep it all. CCRA informed me recently that their program picks up any changes made to youre tax assessments pre-bankruptcy and automatically sends it along to trustee. Any tax assessments or changes to tax assessments post bankrutcy do not get forwarded to trustee

If that is the case I may have to declare bankruptcy again! This does not sound good. I think I stayed too long on the Karma train and this is just a nightmare..just a nightmare...

Red fisher, you will have to send your retro that was owed to you in the years you were bankrupt to your trustee so they can distribute iit to your creditors. If you owe your creditors nothing, that means they are already paid off, then the trustee must return that retro to you minus 15 percent fee the standard trustee fee. A guy I talked to today at my legion will lose his also because it falls in his bankruptcy years, before discharged, that's what his trustee told him yesterday, and revenue Canada will inform the trustees as required by law,sorry

Worst case scenario.
100% of refund taken by CRA because of previous bankruptcy.
15% for lawyer fees.
20% taken off for taxes by SISIP.
= minus 135% minimum
= paying retro child support on the retro amount
= paying CRA back taxes for years.
= How am I going to get out of this one?

My situation,
3%, 3.27% and 5%
11.27% interest = about $7300 in interest top up.
15% legal fees = $10336
= $3036 out of pocket to pay the lawyers.
I can't work out my personal retro refund to work any way that will land me in the clear. Maybe I am missing something, again.

SO you are saying that if you where clawed back 100,000.00 you will only see 51 or 52 thousand.
Wrong calculations there wheres the interest???

This isnt rocket science even if Peter say it is We should get back 100% of our retro (offset) plus interest ....minus taxes and legal fees ....Average money in our pockets will work out to appr 51-52% after GOC and McInnes Cooper get their portion.

After everything added and deducted i get 51.2 % of the offset! Taxes legal deducted ....interests added .....etc..... 51.2% of the offset ..... I repeat 51.2 percent .... We all had to pay taxes even if we got it when we should have.
The only additional costs are the 17.7% legal fees if approved

SO really you have to add what ever you interest was so maybe 43%
