SITREP from Joshua Juneau.

The departement of justice has consented to certification. The hearing is expected to occur in january 2017 and will be approximately 10 days in length. A decision is expected in the summer of 2017.

To me it is a kind of good news.

I enquired about the lawsuit. Here's what I received.

"Thank you for your email. Certification is proceeding on consent. The Crown will be preparing their statement of Defence within 30 days. Please follow up in mid-February so that I may let you know the contents of their defence memorandum".

Throne speech for the Liberal vision of their mandate. The Governor General makes it at 2:30 eastern.

So this is when the veteran community finds out what they are going to do and when. Also make note of 'when' in the speech veterans are mentioned. It's all about priority and if vets are mentioned near the end it will not sit well for vets.

I emailed Michel Drapeaus Office yesterday to ask about the progress of this lawsuit and to see if the certification that was supposed to be done in October had gotten completed... Please see the reply I received below,,, I hope people don't let this issue die, because it seems like everyone has gone radio silent on this... keep in mind the amount of money they stole from us all and the slap in the face repayment of about 8% of what they took... I hope the Libs will not fight it in court and waste more tax dollars fighting it

Thanks for following up. The certification process was delayed because of the Federal Election. The hearing should take place within the next 60 days or so, but has yet to be scheduled.

5.      We encourage you to monitor our website for any developments and continue to keep you apprised as this matter progresses.

This is the follow up I received on 14 September 2015

Thank you for your email – there has been some progress that I’m happy to report to you.

As you know, before a class action lawsuit can commence, the matter must be certified. This means that the court must agree that a class of persons exists with the same issue and that the issue should be heard at the same time. Last month the Crown consented to the action being certified, however the terms are still being worked out.

In the coming months, a hearing will be scheduled before a judge to have the certification motion heard on consent. After certification is approved by the court, the action will be on foot, likely to commence sometime next year.
