Sabre, those are the exceptions not the rule. There will always be lapses in any system, and there has been only three known examples of this out of probably tens of thousands of correspondence that has been sent by all parties.

Bigrex, I was paraphrasing para 29 from the approved agreement. Your right in that SISIP doesn't have to track anyone down, but IAW para 29f, they do have to report to MC any letters that were returned to sender.

Sabre, SISIP doesn't have track down anyone. That is the responsibility of MC. That is why they sent out the address confirmation letters, so that they have six months to find the ones that did not return it. As far as the time taken, if MC can send out 7500 confirmation letters at the same time and at least everyone on the forums received them within the week, regardless of location, I can't see it taking an organization like SISIP/Manulife weeks or more to complete the same task.

IAW para 29 of the settlement, there are 4 ways that the Notice is to be distributed:
29a - Manulife is to mail the Notice to the last known address on file for the Class members
29b - the Notice will be published on the MC website and a link shall be placed on the front page of the Veterans Affairs Canada and SISIP website
29c - the Notice will be emailed by Class Counsel to class members of whom they are aware
29d - the parties will issue a joint press release in respect of the Notice
29e - the Defendant will pay the cost of the providing Notice
29f - the Defendant will advise Class Counsel of any Notice returned to sender, and Class Counsel will be entitled to take any further steps to locate this individual at their own expense.

It does take a long time to print and stuff 7500 envelopes. And with Canada Post's track record (three weeks for a birthday card to arrive at an address 3 hours away!), I would imagine that is why people are receiving the letters from Manulife at different times. Also, if they wait to mail them out until the claim is processed and the Notice is returned to sender, it doesn't give them any time for people processed in the 5th or 6th month to be tracked down within the 6th month period.

Well I guess anything is possible, just the fact that they are sending out the letters at different times, would reflect that. Like you have stated in one of your post, when the next batch is sent out, we will be able to compare the ones on the list, to the ones that have received the ANNEX C letter. One thing that has be baffled, is why are some people receiving two letters.

Yes, but it doesn't say when they have to send it. If they send it out as they complete your file, they are still within the letter of the law. I know, wishful thinking, but with upwards to 2000 files being completed this month, the couple of dozen notices received by forum members is still within the realm of reason. after all, if last month was any indication, we had 4 members get their cheques out of the 214 sent. That is roughly 1.8% of the completed files belonging to forum members. So if 2000 are sent this month, the 1,8% mark is 36 members, and so far 25 have stated they received the Annex notification in the last couple of weeks in this thread.

I think I know why we have received the ANNEX C letter from SISIP. Para 29 of the proposal states that [ Class Members will be provided notice in the manner set out below ]

29 a) [ The Defendant shall instruct Manulife to distribute the notice to the last known address on file for the Class Member ]

This may be the reason for the ANNEX C letters.

Like a number of others I recv'd my second Annex C. And definitely agree a total waste of paper and money. Not on the May list for the retro and get to try the app when MC says we get to play again in June.

Two Letters = two retro's.
