any suit over the CIAS being lost would go nowhere im afraid .

See, it's hard to say, because the only people who will not even have had the opportunity to apply for the CIAS, are current serving members. So it would be up to a judge, to decide, if the potential number future Veterans that would be affected, would offset the relatively low number of current class members, when deciding whether or not to certify it as a class action.

I heard today that vets who are going to lose out on the disappearing CIAS are planning to sue as well, but they'll probably get as far as the equitas lawsuit.bigrex wrote:There have been class action cases filed, but there are a lot of hurdles to overcome, before a judge would ever hear the full case. I thought the courts were involved?the new minister says he plans to make it his priority to see all vets paid before 2020, but considering he may only be in power for 9 more months, I doubt We will see any progress on this.bigrex wrote:yes, you will get something, but nobody has said exactly how much, simply based on your %. there is no chart to figure anything out yet, correct.? I.e. I agree that most will be lucky to get triple digits, but someone who was at 100%, plus other benefits that are indexed annually, like EIA, clothing allowance, and Attendance Allowance, for those several years, could be in for a shock.

Basically, if you were getting a monthly pension under the PA, you should fall in this group. The thing is the OVO said that the worst cases, was a difference of hundreds of dollars per month. So say you were a married Veteran started getting a pension in 2002, and by 2010, it had increased to $2400/mo, by the time they started to calculate COLA properly. But if the Veteran SHOULD have been getting $2600/mo in 2010, if COLA had been applied properly, then every COLA increase since then will be incorrect, even if they did use the right indexing percentage.
$2400 plus COLA 2011-2018 = $2800/mo
vs
$2600 plus COLA 2011-2018 = $3027/mo
So every PA Veteran should be getting the lost COLA money, from 2002 to whenever this does get paid out, as well as having an immediate bump to their monthly PA pensions.
