Ya, I saw that. To be honest I'm surprised it took this long. Not that I think it's a good idea.

I was deemed DEC about a year ago. But, the decision was made by my local VAC office, not in Winnipeg.

I don't get it either but the " rule " is BPA can only intervene on denied or disagreed upon disability claims. But VAC holds all the cards when it comes to fighting a denied DEC claim, you literally have no one in your corner. The ombudsman will look into it in about 5 months, there is also your MP and the Legion but they are all bark and no bite.VAC does what VAC wants in DEC issues.Six-Actual wrote:Zodiac wrote:Just wanted to let everyone know Bureau of Pension Advocates is not the place to go for a 2nd Level Appeal. I called them yesterday.
Curious if anyone else has been denied lately (for DEC)?
Ah man, that sucks. I didn't know they couldn't help. I still can't understand why.

you cant appeal a DEC denial through BPA, you can appeal it twice but its looked at by VAC employees to decide fairness ...wolf in the hen house. Once VAC investigates VAC ( and denies you both times, lol). You can the go to the Ombudsman, who is also in bed with VAC, but good luckZodiac wrote:Just wanted to let everyone know Bureau of Pension Advocates is not the place to go for a 2nd Level Appeal. Re: DEC DECLINE SINCE 1 APRIL 2019
this new DEC ,inter disciplinary team is supposedly located in wpg. Supposed to handle all DEC applications for the country.if yours said N.S. it may have been one of the last boards before this new unit got stood up.Zodiac wrote:Has anyone had a decline for DEC since 1 Apr, I just waited 7 months for a response? Declined in March, appeal sent in April. I have been informed that this is the new normal for the new DEC unit, where ever it may be. The letter came from Nova Scotia. 40 % for PTSD and 45% other medical issues. I am at a loss and very disappointed of course.
Any ideas from the wealth of knowledge here on this forum?

No, I was at a loss of what to do, but that seems a good idea. Thank you!

Then you have a strong case for appeal. It's unfortunate this is the route VAC has put you on, but you're in a good position to win your appeal.

Your percentages don't have a role in a DEC decision so to speak.
You must have a barrier or barriers that prevent you from attaining and keeping gainful employment, based on your skills, education, training and experience.
