ELB CLASS ACTION LAW SUIT
Too bad the ELB case will likely not see a court date before the next election. Because after fighting the SISIP case for five years, the current Equitas lawsuit, as well as the RCMP LTD lawsuit, the Tories would be even harder pressed to claim support of disabled Veterans, after arguing against just that, in a fourth class action lawsuit seeking improved benefits.
And the Tories keep saying that they are waiting for clarification from the courts, in each case, but if that was the truth, they would not appeal at every turn, when the courts tell them that they are in the wrong, or try to have the case thrown out of court altogether.

What do I see here, first the sisip class action suit, second the NVC class action, and now the ELB class action.
The first has been won, the second and third if won would in my mind set a precedent not only for every law firm in the Country to want to jump in when called upon to fight for us, it also could - or would be our edge in receiving what we deserve in our final battle to get the benefits that we are asking for.

this is an email i received from Michael Drapeaus office last week,,,
We are writing to provide you with an update into the ELB class action. We are pleased to inform that a Statement of Claim has been filed in the Federal Court challenging the deduction of VAC disability benefits from Earnings Loss Benefits, Canadian Forces Income Support Benefits, and War Veterans Allowance. Counsel for the proposed class action have prepared a class action certification record and the matter has recently been referred to the Office of the Chief Justice for appointment of a Case Management Judge who will determine the schedule for the next steps in this matter. We will continue to keep you apprised as the matter advances.

hows this for cool..i get a small pension,3200 for my hearing loss..i fight for more,,get a hearing at b of pension advocates. but because I went to my ear surgeon for an opinion I got medical mumbo jumbo that had little to do with hearing loss. but a lot to do with medical malpractice by military doctors,,from this the bureau of pension advocates decides on their own to proceed with a case that is specific to the 17 different t-tubes put in my ears over my career . they call me to tell me they have started it up..this MUST be a good sign right..when they create a case based on doctors word..without me asking!!..I might actually have a good case here..and since by end ofmarch me and elb part ways..this is perhaps a really good thing...just thought ide share the fact the bereau is still trying to find cases to pursue,,i think lol

I called the VAC main number, and once the guy verified that there was no ELB letter enroute, I asked to speak to her, and this time they put me through. People were told it could take up to 2 months to pay everyone, and it has been 9 weeks since people first reported having the money deposited, So I wouldn't sit around much longer. like I said, mine was stuck somewhere along the line, and if i hadn't called, it may have stayed there. So if it can happen once, it can happen again, especially if it was the same person processing our files.
