First and foremost a huge thank you to all for the positive comments and the push in the right direction. I am extremely grateful for the assistance.

As of today CPP and DTC forms have been offered to my family doctor for completion with a final review and sit down with the doctor to be completed next week.

Mcinnes Cooper has been contacted with a long winded email sent to Mr. Peter Driscoll to see what direction can be taken.

VAC has been contacted via "MY VAC Account". I missed a phone call from my CM but at least I know VAC got my message.

Once I start to receive info will pass any pertinent answers for fellow Veterans that might be going through the same situation with regards to ELB and LTD or for those just interested.

Will do LTD4me. and I do follow you, there was a a time period between end of 24 months and the start of ELB(15 months)...will look into that also and get back to the forum.

This site is awesome. kudos to all for pitching in to helping Veterans.

I agree LTD, birdgunner you heard it from LTD Very Happy he is correct and maybe you will have some advantages coming into play with his train of thought...keep us apprised and let us know if you need us.

Sparrow In my understanding you are correct if you are on LTD you can't be on ELB and vice versa, but in birdgunners case he has only been on ELB for the last 61 months, what my thoughts were was he eligible for retro from the time he was unable to work post 24 month to the time he started collecting ELB, not sure on the formalities of his case after his case had been closed post primary 24 month of ltd, If you can follow me. either way his best avenue is to contact MC and they will get all the pertinent facts to his case and inform him either way.

That would be a great program birdgunner if we could have one like that for centralized location. But please remember something that took me several years to realize and I still struggle with it when I ask for help from medical personell and that is:
a) take your time with your physician you pay their salary and you had to wait your turn to get into doctors office others can wait there turn
b) you are not sick, lame or lazy so delete that notion from your thoughts. We are not melingerers for seeking assistance from medical.
You are not in the military now so those sterotypes don't hold water anymore
c) at the end of the day no one cares about you but you and your loved ones so who cares what people think.

Will do Sparrow thanks for the info and to all getting me pushed in the right direction.

I do have a family doctor, it took over 18 months to find one. The problem is when I walked in with a foot high stack of paperwork and medical reports from the specialists I had ten minutes to relay my situation and to this day an appointment ends with a puzzled look on her face and me with more unfulfilled questions!!

I really wished there was a centralized location for Veterans to go for medical/paperwork issues from doctors who understand the complex world of VAC/SISIP/CPP/CRA SOP's.

DZANZIO....definitely apply for CPPD. You should get it on your PTSD and it will have nothing to do with whether you can walk to Tim Horton's and back. More than likely your GP doctor will not be able to help you much though and you will probably need the recommendation from a specialist. Good Luck.

birdgunner, you should at least apply for DTC and CPPd applications. As my family doctor stated to me, her job is not to determine if someone qualifies or not for CPPd, her job is to simply fill the forms out with pertinant facts (with a fee) and it will be decided by GOC. As for the DTC, altogether different medical criteria and you should apply for that as well. Do you have a family physician?

Agreed, after the first two years, SISIP closed my file (after I told then to go F----K themselves, when they recouped $10,802.00 from me) I've been in and out of jobs for the last 10 years, know unemployable....no SISIP for me cause my file is closed, PERIOD! WTF?
Not all service related issues or diseases render someone disabled at the 2 year mark.....or is it a clause for profit margin? mmmmmmmm?

Thank you for the swift replies.

McInnes Cooper has had my info since the start as they sent me a letter dated October 2008. In the letter it states "the GOC has provided us with info that you may be a former member of the CF entitled to participate in the Class Action"...unless everyone released around the same time period got the same letter.

I did update my info with date of release, start/end of 24 month post-military period, start of VAC Disability cheques and amount deducted this was sent to McInnes Cooper (Kristine Hunter, dated 28 June 2012) via email.

With regards to CPP, have never applied as after looking at the qualification criteria and the inability to find a Doctor that will do paperwork I just gave up. Same goes with Disabilty Tax credit as I have on average owed back to CRA $1700.00 per year for the last 6 income tax years as I am unable to fill in the medical paperwork.

With regards to the 75%. All I can say is that my combined pension and disability cheques doesn't come close to meeting the 75%. I am being topped up to 75% by the monthly ELB...this is all confusing as monies were deducted from ELB until the courts told VAC to stop the deduction(thanks Dennis!!).

Yes very good point bigrex, somewhat like being "grandfathered in" clause that if your health deteriated you could be re-evaluated by sisip and rebooted so to speak into their system they certainly would do it going the other direction if your health improved so it would make sense if it was fluid going in either direction benefit wise. Great point but sadly not what an insurance company would like to offer.

I personally think that part of the problem with SISIP is that once you were removed, there were no avenues to get reinstated, even if you were deemed totally disabled 1 day after the file was closed. I think that there should be a timeline available that if your condition worsens to the point of unable to work, totally separate from being zero sum client covered by the lawsuit, in order to get reinstated.

birdgunner, read your post. I was actually pleased to see that DVA did the paperwork and you are on ELB since that point. Very well done. As for DVA directing you to Sisip, I don't think that is a concern because at that time Sisip Ltd was not available for you to access. Now with the case it could possibly shift for you but I am unfamiliar with ELB a great deal. I have read on csat members who were on ELB but now qualify for Sisip LTD going forward will be taken off the ELB. Anyone please confirm if you know. Whether you receive your benefits from ELB or Sisip to me seems inconsequencial as long as you receive them. Albeit ELB may have some additional benefits like counselling and a top up amount at 60 or 65 years of age but I am not certain of that fact. So my suggestion is that you contact the lawyers, determine if you are on a list, then contact DVA and talk to your case manager. There will need to be liason occurring but I think you are in good standing from my point of view..Does anyone concur or do I have this wrong...Sparrow

birdgunner were you making more than 75% of your pay at release after the initial two years. ie with your military pension and cppd (are you getting this) and your dva pension was all this added together more than 75% if so then chances are you would qualify for some retro this is only speculation on my part or anyone else here sorry could not give you a definite answer, your best bet would be to contact the law firm its free to talk with them.
