I have still not received my first two years retro and the appeal is for retro starting the first day after the first two years until the present day. I am zero sum.

firebird, your were denied TPI in May by sisip, if I remember correctly.

So you had 90 days to file and appeal with the adjudicator from the day sisip denied you TPI. So you have already filed, so your within the correct timeline.

So now that you have registered your appeal through the adjudicator, you become exempt from the six Month timeline, as ordered by the Judge.

So if successful with your appeal through the adjudicator, your payment will follow. It does not give a time period for that, but you will be sent the decision in writing.

I sent mine in February for instatement as I was never instated , zero sum therefore I did not submit paperwork at the 18th and 24th month period , and was denied TPI in May. I am appealing through the independent adjudicator , so are you telling me that a decision and payment if deemed TPI must be made 6 months from February?

Yes, but the more I think about it, the more I believe the judge just verified that he meant that every class member is to be paid within 6 months from the day he signed the order, not six months plus a few weeks. The only exception is those zero sum clients who are seeking reinstatement and are still required to provide documentation. Those individuals have to be paid within 6 months of SISIP getting all the required paperwork. That is why, if you plan on requesting the third party adjudicator, I would be sending all your supporting docs to SISIP now, as it will only hold up your payment even longer if you wait. If you had your paperwork in to SISIP by the end of Apr 2013, there should be no delays.

Yes bigrex, I agree. I also think that if manulife does not increase the number of processed claims for the Month of June. They may have to start working Weekends, and or overtime. You know when we served, if there was a timeline to reach, we made it happened.

What I'm taking about is this newest legal discussion, might not have nothing to do with paying out to Zero Sum clients. It could be about the very fact that the 6 months end mid month, so SISIP either has to have everyone completed by the end of September, to meet the Oct 15 deadline, or they go beyond the allotted time frame and pay the remainder at the end of October, which apparently is their planned schedule. IF this is what the latest disagreement was about, then the entry today should set SISIP on the proper path, which is to have everyone get their retro sent to MC by the first of October, or submit a request for an extension. I'm sure that if they do request an extension, the judge will likely be demanding one hell of an explanation.

These are both very real possibilities, since both legal issues have come to light since the last deposit in MC's trust account

Your point on sending out one package per Month, will not work, as stated both parties are being monitored , and the Judge will jump in to address this in a heartbeat.

Sisip is following the orders from, what is detailed in the Judges orders, not what MC says.

Sisip says end of October to complete all files not the 15 th which makes final cheques around November 12th.
