Meteck I know you are frustrated but there is no need to call us bantering fools. This forum is working to get your ELB back and a lot of veteran organizations are also fighting.

The OVO is on VAC/GoC backs constantly about this. We all are organized, we all are constantly trying to fight the bureaucracy to improve vets lives.

We veterans are organized! We are fighting for you to have a better life. We are not bending over and taking it. If anything we are bending them over because the internet is bringing everyone together to show the Canadian public that VAC/GoC used to bend us over and they said very loudly "No More!".

That's why I'm saying start the "act morally correct" to all politican's, press and letters to the editor.

Focus on the fact that one word difference (benefit v income) should not give the GoC the legal high ground. Rather they should take the morally high ground and do what is right...take care of the seriously injured.

Funny how the NVC just proved it is a penny-pinching insurance company whereas the LTD program is an insurance program and they are paying the seriously injured. Welcome to bizarro world folks!!!!

Teen you are exactly right in your assessment of the ELB retro, the two “contracts” are worded differently and the main reason we won this lawsuit was because of one word income. The feds feel that by stopping the claw back on the ELB and other allowances going forward they were going above and beyond what they had to do legally and was morally the correct route to take, they however felt that any retro amounts to those programs were going to cost too much when there wasn't a legal requirement to do so. Remember as it has played out thus far it has cost 1.9 billion. Im not saying this is right just how i believe they feel.

Here is my opinion on why the ELB has not stopped.

In Justice Barnes decision page 25 para 59 he states that the CDS used the word income for LTD but in the NVC ELB was written as a benefit.

So under LTD you really can't legally screw with income. But under ELB it is legal to screw with benefits.

So legally VAC/GoC is withing there rights to keep clawing back the ELB retro. Now morally that's a whole new ball game.

So I think the new push to VAC/PM/MP is tell us are you exercising your "legal right" to continue clawing back our ELB? Because morally they are acting like Snidley Whiplash tying severly injured veterans to the railroad tracks!

Well all there is left now is to wait for January 15th to be told something will get rolling mid-February as everyone is still recovering from vacation.  Then the promise of decisive action and something happening in March.  Another year goes by.
