Totally agree Propat, my comment was based on a long line of fee questions and statements. They are spin doctors but tha'ts their job they are a business we hired we just did not direct them correctly and that's our fault. Well not mine cause I opposed it. LOL

I can only imagine how frustrating it is too all of us here and how many have or will serve in my opinion a truly wonderful service to ones country, a soldier. But let us not be awe-struck 2 Truck, this whole process should enlighten many as to how any soldier is regarded, no funding, reduction in size, new VC, still imposing taxes on severely disabled veterans, systematically re-routing blame to other sources, privatizing within the civilian sector, making unsound military capability ventures, and finally 2 truck stealing millions from disabled vets and refusing to admit it. Finally please look in Ottawa at the NMC in Ottawa and ask yourself why do you have to apply to be buried here, answer they wont bury you if your broke.

rags agreed its all done now unless the deal is rejected and the lawyer fees are something i have said many times in the past are a negotiation between the leagal team and the judge.but when i seen what MC put on their website showing even the low value cases to bump up the percentage numbers and then showing the average percentage numbers and not the average payout well cummon really.oh buds someone had to show the whole truth not just half.you know as well as i do rags what they are doing their.spin,spin frackin spinn.

Rather then getting caught up in the numbers, it is what it is, a really big number. The time to have dealt with this has passed the deal needed to be stopped if you wanted any kind of reasonable relief from it. It is simple to look up what they will get and deserve. You go to table of cases fought and settled or won at Federal court look at the total value of case and the total recovery % in case and then see what the judges have ordered as fees. To add to this % up or down then you look at how much work went into case ie cost out of pocket to fight case, did it go to all levels of court did it get settled or go to trial.. You will then get a feel for what the judge will direct as fees.
So formula goes like this in recap:

Total Value of Case = W.. 887million.....possible 1 billion
Total Percentage recovery = X....100%....normally 50 to 70%
Work Performed = Y.....in this case not alot but they did go to supreme court and have a appeal.
Total Expenses = Z.....3 lawyers para legal x hours worked regular rate. Plus 100K out of pocket.

In the end it works out to about 3 to 7% straight across the board. Could be down as low as 3% if amount of work on case is low and high % of pay out recovery by class. and up towards 7% if work is high and payout low.

In our case high pay out and low work costs. So I guess 3% to 4%.

The real issue to debate is why we did not refuse the initial first offer of settlement and go back to negotiation where we could have gotten a 50% pay of fees by GOC or go to trial and get all paid by GOC.
They deserve to be paid and paid well. What they get paid is judges choice based on procedures, law and past case law. So dont fight that it is what it is. As I said all along dont fight the pay fight for who should pay.

We screwed the pouch on this one we had the power and the time to use it the vast majority chose not to do anything.
The judge has a very tight area to select the fee from so it is all pre set and he will do a proper fair judgement.

RobbieRoyal, I respectfully disagree that the GOC could care less. There may only be 7500 of us in this class but there are over 100 000 veterans and how many friends , family do these veterans have.
The treatment of veterans could have an impact on future recruitment. I am sure that the military does not want their slogan to be " Join US, We'll use you , abuse you then Show you the Curb!"

ok by MCs own examples the average fee is $5,233,032.12.my question is why are they asking for 12 times the average???four times the average is 21 mil it seems a little crazy to me to give four times the average but thy did a good job outside the tax issue so maybe its warented.but 12 times the aveage????can anyone who is happy with the leagal fees justify this for me im obviously missing something???

OK troops here is a touch of reality for you and rest assured it is a bitter one to boot. If this ever went back to court "The GOC" really could care less about shooting themselves in the foot for reasons above and beyond us 7500 veterans. In a country that is growing as we speak 7500 votes is a far cry from how many potential votes will begin to vote each year. We have become such an invisible minority that we don't even warrant any publicity. Sure a 15 second spot here or there but how many Canadians actually know our story? If you continue to flood our MP's and all media outlets trust me, our story will grow and it will spread out farther and faster than the GOC or MC could have imagined. Just because the suit is "over" it does not mean that we have to stop telling everyone about our story. Keep writing and demanding answers, post ex drills troops.
