Actually, that had to be a form letter that had yet to be updated, since it is talking about the proposal in the future tense, as if they didn't realize there had been a negotiated deal already agreed to by the time Recon was sent this.
"Canada& counsel for the class are currently engaged in discussion to resolve all the outstanding legal issues in the class action in the hope of achieving a full & finalsettlement of the class action . Should agreement be reached , Canada & Counsel for the class will submit their proposed settlement agreement to the court for approval ."
So, even though, the negotiations didn't involve legal fees, it is during the negotiating process that having the Government cover legal fees would have been broached. But even then, he never comments on WHO may be paying the legal fees, only that the courts will decide on the amount to be payed.

Based on Mr MacKay's letter, it seems the legal fee issue has yet to be determined? Has a copy of this letter been forwarded to the law firm. It would be nice if it came our way. Chris

Sure wish I could get an advancement on my payday until I was 65. Unreal to think Mcinnis Cooper is actually considering taking payment for services not even provided. What happens if LTD stops for me in two years? Will they send me a check back, not likely. Also what about those who only collect the 24months, boy are they getting the shaft.

Yes, if you get reinstated by the 3rd party adjudicator, then you will get paid from the day you were medically released and or had the financial aspect of your SISIP file closed due to the clawback. Then the lawyers will be entitled to withhold their fees from any and all retroactive payments you will receive.

That is why they doubled up the fees on the retro, since regardless of what happens in the future to any of the class members, even if we lost one today, they would still take their share of the amounts going to the widow. But since there are no survivor benefits for SISIP, if a Veteran dies, all payments stop, and so no more future fees for the lawyers.

If the lawyers get 7.5% of our future LTD from SISIP then what happens if we get better and can go back to work. We will no longer be on SISIP so should the lawyers give us back the 7.5% for future earnings?
How can they take this 7.5% when nobody knows just how much or how long we will be on LTD?

If the judge says that we owe 3% for legal fees, it will be based on what each class member actually receives and cannot be charged more than that. Unfortunately, I'm not sure how the law firm will calculate the 3%, whether they still only deduct off retro only, or reconsider fees on future payments. This is why there should have been official sub classes, so that the judge could assign fees according to what each sub class actually gets as far as compensation.
