Re: Legal Fees (Assorted Topics)
This really pisses me off , we have been told over and over , there will be a court date for legal fees after everything is approved , so we are looking at another 6 months fo payment. Believe me very very very positive better mean damages damages damages because for us what else would be very very very positive , actually at this point I really don't know when this thing will end

They already know what the legal fees are. They just want it to be released at the end so VETS don't go ballistic. They know everything they are just stalling to make sure if they can save a penny here and there they will try.

We need to know what was decided in that settlement if the law firm expects us to wait 6 months for a payment?, anything less is cruel and unusual punishment,

It just occurred to me , Legal fees court date
It just occurred to me , once judge Barnes approves the case 14 Feb, that does not mean payment will be coming because they will have to set another court date for the judge to rule on legal fees. How can they pay out any money if they don't know how much to pay the lawyers, and we have been told constantly that the legal fees won't be decided until the case is finished, So believe me, Propat saying the end of April might be right, but a more realistic date MAY 2013 work it out , it's a killer

Well said Robbie, we are Canadian veterans that have served proudly and thus I am more thankful that there is someone that was strong enough to take on the GOC and have them right what has been wrong for too long.
We should be proud of the soldiers who have risked themselves in order to benefit the masses. What has happened as has happened to oh so many people is that they see the mighty dollar and that is all that they can think about. Why not take a minute and be thankful that justice is being served and there will be no suffering for the future veterans, that to me is a better reward than damages.
Do not get me wrong I believe that those that have lost out on so much should be compensated accordingly but anything beyond what I would have received is too much in my mind unless there is damages that cannot be reversed.
I have had my hardships but I did not join for fame and fortune, I joined to make a difference, for pride, for country and for those who could not fight for themselves.

Jesus H cheese boys that was my point, and DHCD hit it on the head. All I said was in a round about way if your in need of 100% then this is not the Class Action you want, if you can live with 70% like propat has said then you are in the ball park. I am just trying to remain positive here troops and I do respectfully admire your courage to pick up the fight or follow the course of action given to us. I will not fight with any veteran when it comes to personal struggles that even 70% can not fix.

Propat is right. Most people are not in it for the "get rich quick", but rather for the "get out of poor/oweing quick". Too many have had to rely on loans and lines of credit just to get by when they should have been able to use that money all along in order to survive. How many do you think would have not lost their homes or cars had they just had that extra income from SISIP?

Re: Legal Fees (Assorted Topics)
dchd im not sure where the get ritch quick thing got started.i opened a poll some time ago about what the class would accept as a deal(since deleated)in hopes that the feelings of a cross section of the class would be seen by the negotiators.from what i read their and in many other threads moast just want,as a minimum call it a deal breaker if you want.70%in pocket plus interest and tax penelties.moast feel that 70% is what we would have got if we were payed when we should.in that case we would have no tax penelties to pay and could have erned interest.70% in pocket in my oppinion will not make us ritch it certinly will not make me ritch.sure some want 200% in pocket.now a lot (and i am one)do want 100% in pocket but moast of them (and again i am one)will agree to 70%.if you think 70% is reasonable thats fine and if you think its a get ritch quick thing thats ok to.i just dont think moast here are in it to get ritch quick.

Re: Legal Fees (Assorted Topics)
Robbie you are 100% correct this is not a lottery or a get rich quick means.
We would of had to pay taxes on the money anyway but at a lower tax rate then we may pay and Lawyers fees well they win the lottery and get rich quick but such as life most people jumped in so you get what you get.
Most case the money not all I said not all so don`t get jumpy people i know some are really in a bind. But I wish and hope people will use this money to assist them in the future and not live for today. Put your need in front of your want but i know it important to upgrade all your electronic every 6 months and keep up with the Jones i see it everyday.
We get 100% medical coverage and travel claims and yes you can say it don`t cover your expensive i say BS asks for a more if you have proof they will make exception to the rule. Anyway money greed over indulging is most peoples problems not all.

Re: Legal Fees (Assorted Topics)
oh robbi although a agree with a lot of what you said we are in a war.the goc declared was on us in 2006 by imlementing the nvc that in my oppinion is the biggest front in this war on vets.then once they seen we would launch a class action instead of setteling they chose to fight on this front as well.cutting dva front line staff and budget.eliminating dva offices from places like cape breton where the neerest office would be halifax a 6 houre drive.thats 12 hours both ways for some really old vets.the denial of services is allready happening just check the report on vrab.i think it was something like 60% of those they denide benifits never should have been denide(correct me on that point if you will id have to read it again but i know im verry close if not totaly correct).everyone knows that anyone with a nvc ore dva pention can apply for pia but many peeps even peps on here including myself are being told we are not allowed to.it took me two months and a lot of work to get my cm to admit i was allowed to apply.the list goes on.now how many fronts are we fighting on?
"We are surrounded sir!",
"Private, we're vets, we are always surrounded"
i for one am dragging my sorry but to another front when this is over and jumping in a hole.ya can all join me if you want but keep in mind i only allow two officers in my hole thats capt morgan and col sanders lol.

Re: Legal Fees (Assorted Topics)
sailor964 This is not a war, the Class Action was established solely for the purpose of getting the owed monies back into the hands of the veterans. That has been accomplished, this Class Action is not a get rich quick scheme nor is it a lottery it will give you what you are owed plus a cost of living allowance a gross up and then you put back to the GOC what you owe on taxes and a relatively modest amount goes towards lawyer fees. If you can calculate what you would receive after taxes then work with that. The GOC will not rewrite "Disability Qualification Rules" because 7200 veterans got back what was owe to them.

Theres going to be alot of retribution from the government of Canada on what defines anyone on disability to continue on the ELB or any other support system. Be prepare to lose these benefits. They hate to lose.

Legal fees on cheques moving forward...
The reinstatement of Sisip benefits has been done by Minister McKay I believe. There are no fees on our reinstated monies. There are only legal fees, payable one time only, on the Lump-sum award of backpay from the lawsuit. I was zeroed out as well. Now I can try to fix my shattered credit and life. Chimo
