Re: FORM RC4288E Request for taxpayer relief (Assorted Topics)
well I put this out on another thread so I figured its best put here.
we had a few people trying to figure out how to deal with the deemed tax issue twice and it just kinda got derailed a bit by folks thinking we were against the deal or deemed tax don't exist so I went through everyone's ideas added some recent stuff and came up with this.
apply for tax relief.
re apply .
appeal.
wright your MP.
wright the minister with a request.
if successful and I had well over 10 years retro id right the minister with a request to waive the 10 year limit.
and if I was unsuccessful and still owed a very large amount of deemed tax I would launch a judicial review into the validity of deemed tax in the ITA, its application in the regulations and the application of tax relief as it pertains to deemed tax under the fairness provision.
just trying to bring those conversation to a much needed conclusion.
always question authority

well haven't here'd from many yet. sappers is being considered. I got mine k-9 got a nonsensical rejection witch according to ALL the pertinent legislation is not grounds for a denial so he is resubmitting. and diggers was sent back twice because the screener didn't know what waiver meant so she is resubmitting for a cancelation.
1 yes 1 maybe 1 unknown and 1 rejection
kinda how it tallies up right now.
I initially thought very few would get it but im kind of optimistic right now.
I thought their would be so few that their would be next to no chance of anyone on this sight getting it and me of all people not a chance so you can imagine how shocked I was to get mine.
that's what gives me hope.
glad you are giving it a go I really wish you the best of luck.

Re: FORM RC4288E Request for taxpayer relief (Assorted Topics)
thought id repost this with a little bit extra added as to years to fill in .
ok I was asked for this so here it goes .
http://www.cra-arc.gc.ca/E/pbg/tf/rc4288/rc4288-11e.pdf
that's the link for the form
this is how I filled out mine with some slite modifications as mine asked for a waiver and at this point in time you will be asking for a cancelation,
section 1
complete
section 2
question 1.
check B and circle and highlight cancelation.as best you can wright this in the line provided and you will need to use the space underneath .
cancellation of the interest portion of the QRLSP calculations (see attached 1198 calculation sheets).
2.
check other extraordinary circumstances.
delay in payment of my LTD benefits from SISIP by the government of Canada.
3.
wright in your years ( use the years you were charged deemed tax taken directly from your 1198 calculation sheet )
4.
check no
5.
you can use your own words but cover these points politely .
a/ the GOC through SISIP Manulife illegally withheld my LTD benefit payments.
b/they were taken to court and ordered to pay the benefit and all the retroactive benefits for the years in question ( see attached 1198 calc sheets ).
c/ I am asking for the cancellation of the interest portion of my 1198 calculation ( see attached 1198 calculation sheets ).
6.
n/a
section 3
you should only need to attach a copy of your calc sheet I would circle and ore highlight the deemed tax amount's. however you can attach as much as you desire.
section 4
fill in if required
sign and complete
done and done
hope you are all successful
