zero sum , no SISIP during two years
getting retro for it.
Also appealing for LTD beyond first two years which is 2011 to 2013 , so I just wanted to find out the legal fees situation for retro past July 2012.

Makes sense to me that a cut off must exist.

2020 was just an example

2020 , is when a person starts an appeal for LTD going back to after the end of the first 2 years and to current date if it was 2020.

Say released 2009
First two years takes it to 2011
Was zero sum because VAC was more than SISIP amount
Finds out about law suit in 2020
Appeals in 2020 , wins and retro goes back to 2011
Legal fess should only be from 2011 to July 2012 and not until 2020

So if a person appeal for LTD from 2011 to 2013 , current , and wins then legal fees should just be taken from 2011 to July 2012.

So why talk about retro to 2020? Cant happen.

I think July 2012 should be the cut off.

There wont be any ckaw back cause it stopped in 2012' so it cant happen from now on.

I did say from 2012 to 2015

As any money from SISIP due to retro after 2012 is not part of the $424 million of which legal fee's are coming from that would mean that MC would be getting more than what was decided in court. It would be like they also get royalties for every appeal in favour of LTD benefits past 2012.

You were not talking about 2020! But everything clawed back before jugement is subject to legal fees.
