Agreed Winged, my point was about your comment on "it is better then 30%" They were not getting it anyway.

I say make the GOC pay.....thats why we need to go to trial or at least restart negotiactions.

I never argued the fees Rags in fact my arguement is strickly that the government needs to own up to putting Manuge and Driscoll in court period. I respect that they have done something. Of course everyone should be paid and I hope so but not my money sir, no way. I have been screwed over and pissed on by the very government that needs to be held accountable for dishonoring our names and our service to country. Please do not throw court numbers and details that have nothing to do with stealing from disabled veterans, are you right out of it, man your service to country means nothing to them, (government) but it sure as hell does to me. Some of you people need to realize that the real issue is not Manuge or Driscoll but the whole damned Hill that gets to walk away while we bitch and groan over any of this. Wholy crap man you are a highly intelligent man i see that but if you are willing to sell your sacrifice out to a lawyer that should not even be here, no offense (MC) then that is your right, I am pointing my finger at our government. My fight is not with you and for that I am glad.

White Winged Warrior,

So you understand what area I support and don't confuse it, I think the lawyers have done a good job. They deserve to be paid no issue there. They deserve to be paid in keeping with the law.

If you go look at the law on the fees to class action lawyers yo will find that fees are basd on pay out coupled with the total amount of the suit payment. The fees for this type of action are generally by past order around 5 to 7% straight across the board. The key issue here is not that they could have gotten 30% cause that they could not have by law. (a point I was wrong on my first few days here and was corrected went and did the research to find I was wrong member of site was right). The point is what do they get via past orders of the court and if the settlement is around a billion its 3 to 5% depending on work put into case and payout percent.
So my view is pay them pay them well according to law and lets make sure the GOC pays all or part of it.

Morning disgruntled veterans as most are aware we are
closing in on a day that most disabled veterans have been waiting for, a stamp
of approval from our Judge Justice Barnes. When I refer to most I refer to
those that just want to move forward and get on with their lives and put the
Sisip Class Action far behind them. I for one agree and I will not be in any procession
line handing out embraces and pleasantries to our lead plaintiff or our legal
team of McInnes Cooper namely Peter Driscoll. I believe these parties have
completed their original task and that was to give back our illegally deducted
LTD due to receiving a “gratuity” for service to country and man. I will not
comment on how the legal team has hidden or conversely implied to any media
source how they intend to reap the benefits of 17.83% of the settlement, I
believe it better than 30%. As far as the lead plaintiff is concerned he will
receive what is owed to him and his family and I can be certain he will receive
another encouraging increase from in the form on the ELB reinstatement.

My problem is and will always be how the Government has
shamed this country and omitted the “DIG” from “nity” and torn a huge hole into
the very hearts of all veterans disabled or otherwise. All administrations past
and present have disgraced the faces of the great soldiers that sacrificed
life, limb and soul for service to country by ignoring the policy administrators
from SISIP whom have for years told the Treasury Board, it was illegal to
include non-taxable gratuity payments as other source income for the purpose of
reducing LTD benefits. I am shocked that I see no national papers covering our story,
I see no national television coverage of our story. I see no Lead Plaintiff or
Law Firm representative asking the government to stand tall and accept all of
our disgrace and lost dignity. I only see what I read and from some of the
emails and conversations I have read it appears that D.Manuge and Driscoll have
stated that they have done all they can and it is up to us veterans to carry
the torch. Ok Mr. Manuge with you permission since I am now a certified Class Member
will you in writing forward 1,000,000 dollars towards a 30 minute spot on W5
and allow any veteran the right to speak nationally about the government’s failure
to accept any responsibility for these illegal actions committed against our
disabled veterans. You are paying the law Firm with our 17.38% so ask them to
fork over enough cash to land us that spot on TV. Then and only then will I have
the ability to sleep knowing that we the class as a whole “turned around and
went back for the last man, and we all kept pace with the slowest man”. I do
believe that your lawyer firm forgot about our code and maybe you do also. So I
speak for the man we turned around for and him, does it not feel great to cross
the line together”. Maybe you should ask yourself that as well! HARD TO HAVE A
VICTOR IN A ONE MAN RACE.
