riches i do agree to a point but ya see i will always belive that the judge had a rough figure in his head prior to the 15th and i wouldnt imagine anywhere neer what MC was asking.hell if i were a judge i would as i always like to be prepared.im sure anything said on the 15th by anyone could move the judges amount up ore down by a percentage point but im thinkin thats about it.i think im good with the 25 mil still but that guess is as good as any.

Justice Barnes ruling on Fees -The Fees are 3.2 million ( 6 yrs works) X 4 risk multiplier = 12.8 million- My Guess on the fees .. what is yours?

that will help us yet again fight through "The Dark Ages". Many
important details are being left out and due to a ton of new daily
threads (ok I started a few) many of us 15 members will have to

Follow up on the deamed taxes,
I forgot to say that you bring forward the what was in the docs before, so keep copies of everything and this will be what will be the main docs of the Judicial review. Always write all arguments to a request all the time as this will serve as proof later. Sorry, i'm directly translating from French to English and it is not the same. Be sure that I wont write anything important in English! ;-)

A judicial review is a revision of an administrative decision or law that comes from an governemental office, in a big sense. The Federal Court look at the decision or law and see if it is ok. If not it sends back the decisiin back to the first decider with the reason why it should be look back again.

You could do this with a redress result, a decision on pensions from the last echelon of decision of VA, or any decision from a Fed office. You must have gone thrue all the possibilities and this is the last step. You have 30 days till the last decision to do the Judicial review.
You don't need a lawyer but it is a hard job, Fed Court is really administrative oriented with lots of Rules.

So this is why, even if you know you will be rejected, it is important to do all the steps without one missing and be within the timings.
This can the serve as jurisprudence for others and open doors. You could be lucky and even have Judge Barnes as a Judge.

I don't know the chances of changing that politic or rule or law but it is the only way. You go all the way or do nothing. Hope this helps. Big big job, but possible.

ya im with ya k-9 as i was planning on doing this anyway kinda why i was telling everyone to apply for this.i did get some critisism for that so all i could tell them was hey it takes 10 minets so if you dont want to waste your time dont but i will.

K9 I have a Tax court of canada decision where the judge agrees that deemed taxes, are" Interest." he said if it quacks like a duck walks like a duck its a duck. this is important because CRA says its not" Interest" and therefore the Minister of Finance cant waive the Interest of Deemed taxes.

then the CRA said that QRLSPs have there own special tax calculation ,so that is our way to deal with the taxes, But as anyone can see, long retroactives, dont get much relief from that. Its a catch 22, which leaves long retros with little relief.

I will also file all those papers, and join you on the Judicial review.

Sapper, make sure to ask for the deamed tax exemption to the Minister,
It will be refused but to appeal you need to ask.
Then you know that the appeal won't work to.
I will chalenge this in Court as a Judicial review, that wasn't done.

Good chance it might work.
