im with bigrex on this one I didn't want to apply for any benefits prior to release but the NVC forced my hand . I applied 30 days exactly prior to the change . 4 moths after the change I got my decision with a note. something to the effect since your application was submitted prior to april 1st you are covered under the PA not the NVC YADA YADA YADA .
if I got a crapy result and had to appeal and won id expect the same treatment.
before starting any legal action id follow bigrexes advice and contact the OVO .
failing that sue those no good for nothing but eating benefit steeling beaurocratic but clown fracks.
this is fracking BS they specifically stated prior to the NVC coming into effect that all claims filed prior to april 1st would be covered under the PA after that they would be covered under the NVC.

Is the injury consequential to your injury covered under the PA?
If it is in no way consequential VAC will fight you to have it taken care of under the NVC. Of course it is not what you want but it does open the door to the benefits under the NVC which you were not entitled to under the PA.
I have friends that fought to get an injury recognized under the PA and the battle was long and hard. I don't want to in anyway discourage you but the success of these appeals is maybe 20% and took a minimum of a year.

As long as the initial application was dated prior to Apr 01, 2006, it should be covered by the PA. It's not your fault that the appeal process took several years. I would probably get the OVO involved, if VAC refuses to reverse their decision.

Unless it is a 'consequential' injury releated to your original injury under the PA any new injuries going forward from 2006 will be dealt with under the NVC.

Did this happen to anybody else ? a few years back before the NVC came into effect take note I am under the PA I had applied for reflux now this application was submitted well prior to the new NVC and of course they denied my application on my fist attempt I then appealed there decision and won now this is what vac did they back dated the payment up to the date of the new NVC so I got a small amount of money but here is the kicker they vac informed me that there would be no increase in my monthly pension due to the new NVC just looking for some input on this situation before I get some legal advice on how to deal with this THANKS

I just got off the phone with DND pension office. I actually talked to a guy who knew what he was talking about and explained it clearly. So, I owe them the bridging payment on my pension backdated to when CPPD started. The actual calculations and letter of what I owe them won't be sent till late December as the section that does these is 3-4 months backlogged. Once I get that letter I send it to VAC who will then re-calculate what I owe them minus what I have already started re-paying. The guy at the pension office said the dominos don't fall in the right order and they don't communicate with other federal depts. So it's another waiting game which hopefully ends well.

do not forget to ask for your T4 slips come tax time I believe it is automatic but I asked for a break down for my records and they sent me a work sheet, probably crap but i got one anyhow lol
Also for your DTC take a copy (your certificate to your Income Tax personal) and have them file a copy to your records

Thanks TT. I have 15% coming off. RR i hear you man. Like Pinger said there will be a pecking order which I think will be DND pension minus CPPD and ELB will adjust to new DND pension numbers. Just another hurdle in the continuous shell game with the GOC. The good news is Fantino said we will get a $70k top up. Ya right when pigs start flying. If they do I hope they have a dump on him as he is getting into his limo.

One other point you need to remember Prawn YOU set the tax deduction on your CPP D. It is not automatic.
So consider all your tax deductible payments then set the amount or percentage. A good rule of thumb is to tell CPP D to deduct 10-15% for taxes.
