Steelgunner. they will not deduct the new disability pension from ELB or SISIP LTD, or they would face yet another lawsuit. The Federal Courts have already stated that it is illegal to deduct pain and suffering compensation from income replacement plans, so I highly doubt that they will go down that road again.

I don't see it in the legislation propat , this is what I have read to lead be to believe it's indexed;
The maximum amount of the disability award, which is paid to all veterans who have suffered a serious illness or injury related to their service, will rise to $360,000 from $310,000, starting in 2017, and will be indexed to inflation. Any veteran who has received the disability award since 2006 will get a retroactive top-up.
I'm sure I heard our MVA say the exact same as above.
The maximum amount of the disability award, which is paid to all veterans who have suffered a serious illness or injury related to their service, will rise to $360,000 from $310,000, starting in 2017, and will be indexed to inflation. Any veteran who has received the disability award since 2006 will get a retroactive top-up.

yup I see what they said in the budget announcement but until I see it in the legislation somewhere either the act or the regulations I aint buying it.

Propat starting in 2017 it will be indexed to inflation.
I take from what I have read is that it is going forward.
Steelgunner I agree it's a mess and it will continue to be a mess simply because they are not addressing the main problem which is bringing back the lifelong tax free pension.
They need to focus on bringing back the tax free lifelong pension , all the other improvements are fine and certainly welcomed but they are missing the point.
Why are they waiting until next year to start the retro ?
That right there says it all , they got a big surprise for us and it's nowhere near what the PA was.
It's also starting to look like those who advocate for bringing back the PA are not invited to have their voices heard.
They need to get their priorities straight and so far I don't see that.

The first thing the Liberals should of done is scrap the NVC and reinstate the PA as it was.
That would have solved the problem , and once that was done they could have merged the merits of the NVC into the PA.

Regarding the pending top up of funds (360K) and the pending reinstatement of a pension we should be treated like past veterans. I firmly believe this. One Veterran - One Charter - One Plan - Same plan
But, I was thinking. If they top us up and add COLA and we either stay on ELB or LTD is that not more then if we get a penision. Because if they give us a penision that amount would fall into the 75% current ELB or LTD and hopefully 90% soon. I will also add why not 100%.
This is of course based on staying on ELB or LTD in the long run. They should have never changed the system, it's a mess. If you fix one area and add a new clause in another area but don't fix this mess your just making it worse. We want what is fair for all, I do not know all of you but we need to band together for a common cause of getting the penision back. I wonder if the past penision veterans are speaking up for all? I hope so and please for give me for saying that if that's the case. I am new to this, just being released 3B in Sep 2015. I do find you have to be your own case manager to get any thing done and speak up to VAC and SSIP.

ya trooper for the2006 to 2017 amount for sure but the COLA for past that doesn't seem to be addressed unless im missing something .
if they are bringing it in line with the other benefits and back date it to 2006 I understand the calculations but NOT the gawd awful pathfinder loop the legislation is going in to get there .
id really like to see where they are doing this how it is written with dates .

Propat the only thing we can do at this point is guess , and my guess is that the COLA adjustment would be included in the increase amount of the $360,000.
In other words my guess is that the increase of the award includes the COLA adjustment in it.
Something is off here with regards to only implementing this April 1st 2017.
When questions are not being answered , and details/explanations are not given , skepticism is the only word that comes to mind.

Why is it that the award & retro is only going to be in effect April 1, 2017 ?
Why is it that the above question has not been answered by our MVA ?
Why is it that those who are attending these committee meetings on behalf of Veterans are not asking that question ?
Why is it that movement on our file with regards to what was announced in the past Budget is not converted to plain English so that the majority of Veterans can have a better understanding as to what they have brought forward in terms of BILL C-12 ?
Why is it that the award & retro is only going to be in effect April 1, 2017 ?

bigrex yup agreed but given the statement "and aligning it with other New Veterans Charter benefits by indexing it to inflation" kind of tells me that is is not aligned with those other benefits RIGHT NOW witch of course is the case as those that receive those other benefits get increases paid to them while buyouts do not .

Propat, the clause that discusses the indexing may not need to be altered, and therefor would not need to be included in the legislation.

ya lost I sent him a message about this Sunday before last . he has been responding to e-mails thus far but not in a big hurry . im hopeful to get a response but not expecting one for almost a couple of weeks as it has been about a 3 week turnaround thus far .
