And if we have to spread this over a number of years we will be hit with the ontario health premium and who knows what? This tax issue is going to sink a shite load of us, the reason I brought it up was , I was at the Hamilton Legion this morning and someone found out about the ufile.ca Canada income tax calculator, they are just as pissed, most of the guys want the judge to reject it, if not damages and legal fees , not even worth it

Re: Legal Fees (Assorted Topics)
John deer , I have considered everything, follow the damn charts , if you add up everything and say your mystery amount for everyone is 300000, that's everything , interest , everything, take 90000 off for legal fees , then enter the remainder in the ufile.ca income tax calculator, it does not lie, that's 80000 in income tax, which leaves me 130000, it's so god damn simple it blows my mind. McInnes has an income tax division nd as part of this settlement we need to have them provide us with expert tax advice included in settlement because income tax is a killer and if you look at the ufile.ca chart, ontario is one of the lower ones, if you live in Quebec or the maritimes it's about 20000 extra, no joke, So I will say it again , if you are happy with 45 percent in pocket well that's what your getting, get out the xalculator and figure it out, if you could get in the forces you can figure this out, it's shame ful

Re: Legal Fees (Assorted Topics)
Are you also not considering that the 1.1B INCLUDES the ceasing of clawbacks and going forward amounts. That, alone, is going to eat up a huge chunk of that 1.1B.
Ladies and gentlemen, we are not getting 1.1B AS RETRO. For crying out loud!
Also, are legal fees REFUNDABLE or NON-REFUNDABLE tax credits? Just because you can claim it on your taxes doesn't mean you're going to get it all back. If they are non-refundable tax credits, you can bet your sweet patooty that your going to lose a large chunk of them too.

So get on your fu*ken happy faces Brothers and Sisters and Merry Christmas!!
Did you include interest for 10 yrs?? Did you include cost of living increases for 10 yrs??? Did you deducted legal fees on the taxes that is refundable???
DID YOU EVEN LOOK AT THE EXAMPLE IT CONSIDERS ALL FACTORS !
STOP BEING SO NEGATIVE ...GET SOMEONE ELSE TO EXPLAIN IT TO YOU!
YOU WILL BE SO PLEASED WITH YOUR BANK ACCOUNT YOU WILL POP IN HERE AND SAY SO AND THEN DISAPPEAR.
Example: (FOR ENTERTAINMENT PURPOSES ONLY ITS A GUESS ONLY)
$300000.00 owed for 10yrs
-60000.00 legal fees
-60000.00 Taxes will very..legal fees deducted
+ 57000.00 compounded interest over 10 yrs+
+ 50000.00 cost of living increases compounded over 10yrs+
= 287000.00 in YOUR pocket
We are all guessing here but i think you didnt include interested earned and COL - This is going to cost the GOC 1.9 billion someone is getting money! if you believe in miracles and I do - The GoC may 10% chance may pay the legal bill!
So get on your fu* ken happy faces Brothers and Sisters and Merry Christmas!!
Martha were is that rum and eggnog Narvat is pissing me off and he is coming over for drinks!
1.9 billion number
****With respect to new policy decisions, a significant portion of the expected increase in expenses for 2012–13 is related to the Government’s decision not to appeal the Federal Court of Canada decision regarding the offset of the Pension Act disability benefits from the Service Income Security Insurance Plan (SISIP). Following that decision, the Government discontinued the application of this offset to SISIP and decided to harmonize Veterans Affairs’ disability benefits with the changes to SISIP in order to ensure that servicemen and servicewomen who become disabled will receive full benefits and services. Under public sector accounting rules, the Government is obligated to record the full cost of these changes in its financial statements immediately as opposed to the moment these payments will be made to veterans, based on the existing population of veterans eligible for the additional benefits. In addition, the Government will accrue an additional small cost in subsequent years as new veterans become eligible for these benefits. The cost of these changes is estimated to be $1.9 billion over seven years, of which $0.5 billion was recorded in 2011–12. Of the remaining amount, $1.1 billion is expected to be recorded in 2012–13, with the remainder being recorded in subsequent years."

Re: Legal Fees (Assorted Topics)
What are you talking about, 60 percent in pocket will be st the top end of what we get. Go to ufile.ca and they have a tax calculator for every province in Canada . Just input your rough estimate of what you are getting and it blows your mind. Just say you will be getting 300000 minus 30 for legal fees , 90000, that leaves you 210000 left over input this amount in the ufile.ca calculator and I lose another 80000 which leaves a take home of 130000 , that's it, income taxes are insane, it will not be 60 percent, Peter said if I was lucky , it's more like 45 percent, just do the calculations
Guest- Guest
60% is wrong! These are my numbers based on 20% legal fees as suggested once by Peter Driscoll
You will see nearly 90% of the amount raw amount in your account! Some will get slightly less because the interest calculations will be less.
Example:
$10000.00 owed for 10yrs
-2000.00 legal fees
-1700.00 Taxes will very..legal fees deducted
+ 2000.00 compounded interest over 10 yrs
+ 700.00 cost of living increases
= 9000.00 in our pockets 90%
I am making a trip to Hamilton in April if I am wrong you can kick me in the butt!

Re: Legal Fees (Assorted Topics)
At the risk of getting slammed for double posting, I'm going to drop this in here as well. We clearly are entitled to demand the government pay the legal fees for the following reasons:
COSTS
In contrast to the "American Rule," under which attorneys are paid according to contracts with their clients (subject to numerous exceptions), in Canada there are two basic systems for the award of costs in class proceedings.[11] The legislatures of Ontario,[12] Alberta and New Brunswick have maintained the traditional English rule of costs, wherein the losing party must pay the winning party's legal costs, subject to the discretion of the judge to make an award of no costs in certain circumstances.[13] In Quebec, while the traditional cost rules still apply, they may only be awarded on a nominal basis determined according to the Small Claims Court costs scale.[14]
Elsewhere in Canada, notably before the courts of British Columbia, Saskatchewan, Manitoba, Newfoundland, and before the Federal Court, the Ontario Law Reform Commission's proposed "no costs rule" has been adopted.[15] Under these statutes,[16] both plaintiffs and defendants are given relief from the traditional costs rules, and are not generally liable for costs unless it is found that there has been vexatious, frivolous or abusive conduct by a party, there has been an improper or unnecessary application, there has been some other step taken for the purpose of delay, increasing costs or for any other improper purpose, or where there are exceptional circumstances. Significantly, though not necessarily an issue unique to class actions, due to significant differences in the law of damages between Canada and the U.S., Canadian class actions are far less likely than U.S. class actions to attract significant punitive damages.
vex·a·tious /vekˈsāSHəs/
Adjective
1.Causing or tending to cause annoyance, frustration, or worry.
2.Denoting an action or the bringer of an action that is brought without sufficient grounds for winning, purely to cause annoyance to the...
Synonyms
annoying - vexing - aggravating - provoking - troublesome
Example: The constant delays caused by the waffling on an otherwise binary solution - pay - not pay - the judgement to cease was given on the 1st of May, 2012, and we still do not have resolution.
friv·o·lous /ˈfrivələs/
Adjective
1.Not having any serious purpose or value: "rules to stop frivolous lawsuits".
2.(of a person) Carefree and not serious.
Synonyms
light-minded - trifling - flippant - light-headed
Example: The meaningless gag orders that have surrounded the negotiations, we as members of the class are entitled to know all of the details as they occur.
a·bu·sive (-bysv, -zv)
adj.
1. Characterized by improper or wrongful use: abusive utilization of public funds.
2. Using or containing insulting or coarse language: finally reprimanded the abusive colleague.
3. Causing physical injury to another: abusive punishment.
4. Relating to or practicing sexual abuse.
Example: The enormous amounts of added stress that the delaying of the government is causing to members that cannot endure further stressors in their lives as a result of conditions caused by their service.
The Government of Canada has most certainly been acting vexatiously, frivolously and abusively in this matter, therefore they have no other option but to pay the legal fees, surely Judge Barnes will see this.

Re: Legal Fees (Assorted Topics)
One thing I do not get here, If peter said we would get 60% in pocket, there is no way in hell the lawyers will get 30%. Taxes on salaries run at about 30% including provicial taxes. That leaves only 10% for leagle fees. Am I in the field here or deos this have a logic to it?
