Also, Peter Dan and Ward worked beyond diligently to minimize tax hits for all involved, obviously it is more important the more you are owed. I am happy with what they achieved, but again, my opinion only, you folks get to form yours when you see it.

Good points and concerns regarding tax etc...this was one of my hugest concerns, primarily for zero sum folks because of the amounts of retro owed to them, especially long time zero sum folks. Again, limited to what I can say, but I am happy with the interest rates (on retro monies) members will receive and how taxes on the interest will be handled. One key to remember is every canadian has to pay taxes, so we did not win a legal battle against revenue canada, LOL. You very well may see that 3.75% in the settlement but that is not the only interest payable to the class. Enough said.

Invisible benefit? Yup got that letter three years ago from SISIP stating you qualify for our benefits but we are taking it all back because somebody else is giving you money. Invisible benefit = zero dollars! Too funny!

Now that Dennis has given us some hope with regard to legal fees there is another demon that nobody will get away from, income taxes, I believe these will be the true killer and will knock the take home amount of the settlement down. I am wondering if the law firm was successful in getting legal fees deduction for us and since McInnes has tax specialists on pay roll , any advice on how to lessen the effect. I am also wondering did we get a good interest rate for pre and post Judgement because in an earlier post the GOC was giving manulife a 3.75 percent rate, will we get this also? Another thing ponder is any part of the settlement tax free? I am very I interested in the notional top up of income tax interest? Wil this take care of the extra deemed tax we will be required to pay?

The major difference between us and a civilian class action, is the losing party( the government), not only created the illegal policy, but placed each of us in harms way, creating the need for us to use the illegal insurance policy, and they still get a good portion of the settlement back in the form of taxes. If employees sued GM, because they were forced to drive faulty cars and were injured, there wouldn't be a clause stating that they had to buy a GM vehicle with their settlement, and they wouldn't be able to use the excuse of being frugal with public money to reduce their financial liability by refusing to pay damages.The courts don't care if a private company has to declare bankruptcy after paying a large court settlement.

Legal fees should be actual costs much like shop rates. If I go to get my truck fixed I pay for the parts, the labour and taxes. There is a markup on the parts but it is not enough to bitch about. When I get my truck back after the job is done to my satisfaction I pay the man. I don't pay him anymore than the job is worth.
To me this is how things should work in the world, you pay for the services you receive and no more. At a restaurant when you pay the bill it is optional for you to give a tip. A tip is based on how you good you felt the service was. Nobody gives lawyers tips!
