I know that your not a stooge teen, your only passing info, so don't take it to heart, obviously there are some angry people out there that get there hopes up only to be kicked while there down. I guess they were waiting for a better memo. I see on here as well retribution against clients because of this case, ie... losing benefits, cease of ELB, and its going to get worse I fear. i fear someone is going to lose there top and go after someone high up without thinking. Maybe your right sending a message to the press, or like last year standing out in the rain with a picket just to get the message back to the government of what is going wrong.

Hey if you guys want to go public you have already taken the first step you are posting here on an open public forum that anyone can read.

If you want to send letters to the editor please go ahead as a matter of fact I beg you to do it. When I see them in the newspaper I will post them to the Latest News Bulletinboard on the main site because I'm also the Co-Publisher of VVi.

I'm not patting Peter Driscoll on the back...I'm "on his back" to get as much info from him for you guys. I've asked for info about taxes, lawyer fees, interest, backpay, tax deductions of lawyer fees.

So once the DoJ/Toope allow's McIness Cooper to release information Peter gives it to me to post to inform you.

When I "suggest" that you guys be patient I'm not taking instructions from the lawyers to try and get them off the hook. I'm trying to tell you all that the legal system does not ask "how high" when we bark out an order to "jump".

I've been thru a federal court case. It took me two years to get VAC to recognize my injury so I'm speaking from experience.

So if you don't want to be patient that's your choice. But do not accuse me of being a stooge that is controlled by the lawfirm, government or VAC.

I don't know to what extent this memo is helping everyone else out but to me there is no icing on the cake here. It doesn't say alot except sorry this has to drag on longer. I can foresee the veteran's picketing again before the 11 Nov again.

Gent, we received memo # 5 and that's all good. The ball is rolling. So me I will disconnect from this addictive forum for a while, go for a walk and relax.

Bigrex why don't you do the same thing, beside your scenery is probably much nicer than mine....

Cheers

It's not poor planning on SISIP's part. They are with their lawyers trying to find clauses or gray matter to stick it to us. Or they are rewriting policies and getting them approved to screw us.

Rex that's probably going to be their approach. But even for us 'easy' ones I still want them to do the math efficiently.

So I've got my patience hat on that I use when I have to go see a specialist for a 1pm appointment but don't get in to see him until 2:30!

I'm leaving the 'monitoring' to Peter.

Teentitan as the rep or what ever you have to do with the lawyers just stop doing it.

Where the information about taxes and lawyers fees what are they?? they know lets hear it. Why wait break the news now we can take it.

I sent an email to the Lawyers office and they still have not contact me. I guess my payment back from the Law Suite is to small for them to worry about
me????

excellent jumpin hoops teentitan--if you arent getting paid by the lawyers you should be as i hear nothing but backpatting goin back n forth between you two---please drop the mask that you are doin this for veterans--please grow a back bone & make the legal beagles earn their ocean side mansions & stop speakin for the lawyers & make them face the veterans in public not in these one to one phonecalls where noone knows what is realy been discused --is it to calm us down so we dont go public?

database---i agree with the skeptical ones---sisip already has a database & they--- not the legal beagles--- are doin the admin processing---i can only see the legal beagels wanting our info so they can show the judge more reasons to get paid more of our money---thanks again for helpin the lawyers take more of our money

Titan, I agree that there are a lot of files, but the vast majority, can be calculated within a few minutes.Get the easy files out of the way and that allows them to spend the Lions share of the time calculating the more difficult and lengthier files. Mine would look like this:

Year 1
75% of pay = $3508
Deduction -$1245 (CF pension)
= $2263
PA deducted -$1424
SISIP payout =$839

Year 2
75%+2% index = $3578
Deduction -$1272
= $2306
AP deducted -$1476
SISIP payout =$830

So all they have do is calculate ($1424 x 12) + ($1476 x 12) = $34800 plus interest.

Doesn't seem that hard to me, and I'm just a lowly sailor.

I just spoke to Peter, and he is all their for us. I will not tell you his multi level strategy to cover us all, as I cannot bring justice to his fantastic efforts for fear of missing a step; but

I can tell you I will sleep better tonight.
Just wish DOJ would get off his A**, because soon this will be ground for new PTSD cases. bounce

Merci,
It is just that if I need to write submissions, it would be easier and better for me to write them in english, but I would prefer be there in person and explain orally in english the french memorandum I would give in case I need to.
I wouldn't care less if Judge Barnes is bilingual or not and I know that he is a very human Judge, nothing bad was intended in my question, so as I understand, oral submissions will be ok,

Thank you again for all your great work, looking forward to for the offer,
merci,

Patrick B.

Hi K-9. My understanding is that all Judges of the Federal Court work toward becoming bilingual through language training if they are not bilingual when first appointed. If a Judge is not fully bilingual, accomodations can be made to have oral or written submissions of members of the class translated for the Court. So you will be able to send in/present your submissions in either official language and not be prejudiced in any way. Hope this addresses any concerns you might have. Justice Barnes has been a very effective Judge to date and has a full appreciation of the issues argued on behalf of the class. All of his decisions have been released in English and French.

Regards,

Peter

28 September Memo - Page 4 Empty Re: 28 September Memo

Post by Teentitan Fri 28 Sep 2012, 14:17

I definitely sense the frustration but I would like to point out some information that might not be considered by some of the CSAT members...

This is a situation that cannot be rushed because mistakes are not acceptable. Think about it how would you feel if OFSI rushed their audit to get you your money then a couple months down the road you get that "Oooops sorry we overpaid you" letter? Personally I want it done correctly the first time so if they need another month then I will give it to them. Don't forget we are also giving our lawfirm the extra time to audit the audit.

Also step back and take a look at the amount of files that have to be identified, found on the computer or in a box on paper! The last figure I heard was 800 zero sum clients have been identified to date. And the agreement was only reached less then a month ago.

Now I am not making/creating excuses for OFSI and our auditors at the lawfirm to drag the audit out. Rather I am telling them work efficiently because you are not doing a typical audit. You are auditing files for the most severly injured veterans.

Veterans that are living a meager lifestyle who can improve their quality of life with this additional income. So as I said work efficiently when you pick up each file.

And it goes without saying, but must be said, we the class need to be a little more patient. I can make this statement because of what Peter did today...he went to court and got Judge Barnes to instruct OFSI to "improve" their productivity.

So thanks for "cracking the whip" for us today Peter! I have confidence that you will pull out that whip again if the bureaucrats start slowing down again.
