Peter, I do not know you but I am a Veteran who also practices law. I Commend you with regards to coming on the forum and explaining the case to members of the class as they do not practice. I'm sure you can understand they are not aware nor are they paid to know The rules of Civil Procedure or for instance the Federal Courts Act. These are people that are ailing Veterans with ongoing medical issues, so extra care to the fine details are required and it is much appreciated that clarification by a representative be available as it was present here today.

To the class members, the percentage with regards to contingency is in my opinion fantastic to say the least. I am not one to toot anyone's horn, but the firm that handled this action asked for very little compared to other class actions. Remember one very important aspect of contingency basis actions and that is, if the action fails no one including the firm gets monetary gain. I applaud the efforts of this firm and all must consider what they had going into the class action...nothing. As well all of you were part of a very large victory and should be proud that you were part of something that changed the future for other Veterans as well. Maximize your tax savings, speak to financial advisors and move forward knowing that you have changed the system and won against the GOC. Just my opinion

Tracker, we always said that our fee would be calculated on the entire amount achieved, as per the contract, but that we would seek to be paid out of the retro (i.e. how we are paid) rather than deducting fees from future payment. So based on our fee request we can either be paid one time at 15% of the refund or 7.5% of refund and 7.5% of payments going forward. Our view is that the overwhelming majority of the class want a one time payment on the refund.

Class Members:

Interest is calculated each year, so it is applied every year that the money is outstanding. Examples to follow.

For amounts that should have received in 2002, there would be interest of 44.3%

2003 - 5
2004 - 5
2005 - 5
2006 - 5
2007 - 5
2008 - 5
2009 - 3
2010 - 3
2011 - 3
2012 – 4.3
2013 – 1 (depending on when it is paid in 2013)
44.3%

1. What happened to McInnes Cooper saying that they did not intend on touching our future payments? (We were told that your law firm was only going to take a percentage from the Retro)
