The Judge even said it is your money, do whatever you want, and the Firm said in the States you could go to Jail for doing something like this, so wathever happens, we will never know but when Denis will have is type of foundation, anyone including the firm could give him wathever they want.

Pat-The Judge did indicate the firm can do whatever they wish with the money they get ....Even adding to the money Dennis gets.....Will that happen ? We will never know but i hope it does !

Everyone imagine if you had the gavel but remember his limitations...yes or no to the settlement ? The only thing he can rule on is fees so what would they be?

The saying that If it walks like a duck, quacks like a duck, looks like a duck, it must be a duck, all this fee thing is and was is strategy to get the most out of this. The Firm had people' s letters and take stand that were saying that they totally agreed with the fees. It was the main point for McInnes Cooper to the Judge saying we are so nuce that we went from 30 percent of the overall to 7.5 percent of the overall, and that the Representif plaintif and everyone in the Class who did not opt out accepted.
But all this went with the risk and their wasn't that much of a risk. GOC gave it all after Judge Barnes last ruling. Most, Most of the work done on this file was done in the nego.
Yes if they would of gone all the way and finished it all in Court and spent everything to go all the way, they would have earned that 7.5 percent.
This wasn't the case. GOC fought this but in the end gave it all up. They finally made it right and their was no more risk.
Sorry for the example, but when people say we had nothing and better anything then nothing, it means you had quit the fight. Agreing ti give 66 000 000 is like a batterd wife syndrom, going back after everything that happened because she is without strenght to fight and scared to loose the litle she as left.
I never talked to the Court about fees, it is the Judge decision and no way he will give more here then what is deserved.
For your question about Denis, I realy think Judge Barnes would of agreed to more then the 50 000 but the fact that was the proposed stipend in the setlement he said it was unfair to change it because that was what the Class tough the most he would get and wrote or didn't write about it. So he will get 50 000 well deserved.

Believe me they wanted to get into negotiations and not got to trial , This way the ground rules were set for each to pay there own legal fees, and the GOC did not risk paying damages at trial. THATS WHY THEY DID NOT APPEAL. as far as them jumping in on the legal fees , probably they pissed they lost, and want pay back at MC, and it appears as Damage control , as they try to make a PR move to look good. How I see it.

I'm sorry but the lawyers only presented half facts when presenting why they should get such excessive fees. Comparing themselves to most class actions in disingenuous, since most settle for a few million or less, and each class member is usually affected the exact say way, as the judge described that x number of people buy a widget from a company that never worked and they sue. Therefor the only cases that can be used in comparison due to the size and complexity, are what the lawyers referred to a "Super Fund" cases. Ward Branch stated that we are paying less than those cases, except tainted blood #1, and that in those case the lawyers were getting paid up front, but they are willing to wait until we get our money before they get paid. The big difference that they didn't point out, but I did, was that the lawyers in those cases as well as the taxes on the payments were paid by the GoC , and these payments were completely separate from any compensation to the class. Ward Branch also said that those lawyers were able to double dip, by charging class members extra legal fees to those who were required to submit applications for additional compensation, similar to the classes reinstatement and adjudication process, but our lawyers say they are not charging for this process. But once again that I had to point out that the other settlement stated that if extra legal fees were charged to assist with the application, the compensation awarded would be increased by an additional 15% to cover at least half of any legal fees charged. Another difference between those cases, is the size of the settlement and how the settlement is divided among the class.

Tainted blood 1 - 1.2 billion to be spit among the entire class based on illness
Tainted blood 2 - 1.1 billion to be split among the entire class based on illness
Tainted blood - 1.5 billion for an education fund paid by Red Cross
Residential School CEP- 1.9 billion to be split among the entire class based on time years at the school.
Residential School IAP - no cap to total amount to be spent, but each award is capped at 430 thousand based on level of abuse and loss of income.
SISIP lawsuit retro- 440 million to be split among the entire class based on disability and time since medically released.
SISIP Lawsuit future payments - 450 million to be split among up only 20% of the class.

Call of Duty- the only TWO thing the government did right was not to appeal and point out the total unfairness of the fee that MC was attempting to charge.

I think the press is waiting for the Final answer to come out before they get involved, or engaged. just my thoughts. But if the GOC doesnt pick up the legal fees come next Election I will do my ever loving best to remind all Canadians, how we were treated by the Torys.

sams if and when we take a lawyer with us they have to know do not ever tell your client (us) to stop whining and you do it we are finished. YOu can not imagine how pissed I am at those few words. We all have tons in common and we have faced adversity, we we never quit on each other, never. The only reason people are happy with the overall decision is because it is over and after that comment was said on this site, the class action became an individual thing. I for one am glad some people showed their true self and for those i am proud and for those that did not you have done what is right and god bless you buy please do not rub this victory in my face. I am still sad that we have won a monetary settlement but at what price. Look around please, i still see confused and frustrated veterans that too me is far removed from a victory.
