I never signed any paperwork stating I was willing to pay 30% in fees. Just because we are included in the Class Action for no other reason that we were forced to sign up for SISIP when we joined and we were 3b released does not mean that we again are forced to pay 30% legal fees because somebody else decided for us.

To ask to be excluded from something that we did not volunteer for is crazy as we never should have gone to court in the first place. Anyway my point is that anyone who signed papers agreeing to 30% legal fees are then held accountable to that agreement. Anybody else who did not sign papers should not be held accountable to that amount. They instead should be given the opportunity to negotiate a % they are comfortable with. Not forced to agree or opt out.

In the military if one person screwed up we all paid the price, but that is what we signed up for. That was the CF this is not because we did not sign an agreement stating so. How about all those Veterans who still don't know about this Class Action? Are they going to be given the choice to either pay the 30% or opt out after the Judge makes his decision? Those vets will benefit from this but will be forced to pay the 30% without their consent. This is wrong on so many levels.

Never got that letter, and I contacted the law firm myself, but at a later date when I hear of sisip in the news. It may have been to late, but when I contacted them, they still did not gave me any paperwork. But I did read on Leave no vet behind their very few confusing postings that caused so much debate among us. But for 66 million, I deserved some mail. What about those that do not have a good internet connection or live in the country. Do they loose out? The effort was not made, or I would of received mail or a phone call. I had ongoing cases with VAC, sisip and a reviewing officer.

I was not hard to find. I agree with part 2 Sparrow. And if I was contacted, I would of excepted. But that statement is speculation only.

Redfisher, I would disagree respectfully with your idea based on two points:

1. The legal team sent out a Notice of Class Action to all members of the class and everyone had the opportunity to opt out if they disagreed with the terms of the agreement at that time and if one did not then it was taken as an acceptance of the terms. We all had the opportunity to exercise our rights and disapproval and opt out. In fact, it is my understanding some did and one has opted back in according to Peter Driscoll .

2. More importantly in my view is morally. I would not agree that Dennis should pay more than us because he is the lead plaintiff. He is a victim just like each of us at the hands of the GoC and without his tenancity or perservance we would have 100% of nothing.

ya im not sure changing the cap is a good idea.now when i first hered of the cap i really thought it unfair.so before commenting one way ore another i tried to reserch as much info i could find on the matter and suppiseingly didnt find a lot.what i did find however is that they dont deduct cpi on army pention and cppd from your sisip payments so with that in mind i actually do think its fair.now would i support a move to iliminate the cap with absalutly no risk to the above mentioned bonuses?sure i would.one that could risk them?no way.

Didn't MC say they wanted to address, the issue of COLAs, SISIP atm Caps COLAs or CPI at 2% I thought I seen that somewhere in the proposal. Maybe MC wants to try and change the capped 2% to the forwarding years, to be inline with what the rest of Canadians get as CPI or COLAs. Edumacated guess! cost of living adjustment i think.

Well, our lawyers stated that the only two things in life that are a constant are death and taxes. But as I pointed out in my presentation to the judge, in the other super fund cases, that neither of them went to court since they were settled immediately after being certified as a class action, which was one of our legal teams defense of their fees. So therefor the awards in those actions were not court awarded, so they were not protected from taxes by the federal courts act, but both the tainted blood and residential school settlements clearly states that awards were not taxable. It was the Government who stated that these awards were free of any tax implications. They have that power, but they chose not to excercise that power in our case and I stated to the judge that we were not seeking tax free awards, and that we have no problem paying the normal taxes that would have been owed, but simply we did not want to be treated like criminals by the CRA, through tax penalties, as if had been trying to hide this money from them.

Not sure Nav as it was just brushed over in Ward Branch's address to the court. Perhaps someone could advise as I don't know for sure. I understand it is the Consumer Price Index but how it relates to the case not certain.

Justice Barnes we will accept what ever you decide regarding fees without argument.

Additionally Mr Paul Vickery,Lori Rasmussen,Travis Henderson (DofJustice) -paul.vickery at justice gc ca -Helped Justice Barnes with a balanced view of the fees being charged.

The disabled veterans were heard, the letters were read and he J Barnes was moved by us.

The federal court has every detail in order now to make a great decision!

I think it is safe to say 2 out of the 3 lawyers here will become Multi-Millionaires from this one case even after the law firm MC gets their percentage fee , and after all disbursements paid and after Revenue Canada taxes them.

I am glad they will be multimillionaires! << All our lawyers Dan Wallace,Ward Branch,Peter Driscoll (McInnes Cooper) deserve millions!
