COD, my understanding from listening was that normally tax implications resulting from settlement figures from any law suit including class actions, are not an issue that legal would by law be reguired to address for the plaintiffs. Reason being, legal can not change the tax laws, that is a whole other law situation, it is a separate law and nothing could be done. Therefore, legal negotiated between the Crown the 3.27% offset adjustment amount for tax penalties due to retro regardless if one choses to go with "deemed taxes" route or pay taxes in one lump sum year. Everyone gets the adjustment regardless of settlement figures.

I believe that the lawyers said that they asked for class wide exemptions for deemed taxes and the Government said NO. The 3.27% was a guess because they don't know each Class members individual tax situation, but even the judge saw this as too low because he even said that we will lose 20-30% off any settlement for taxes, and was why he suggested on calculating the legal fees based on our net award as a way to minimize the cost to the Class.

Thanks Wife of Vet, I too am anxiously waiting for some closure, sleepless nights, anxiety, stress etc etc etc..... I really don't give a crap anymore. I thought three tours overseas was bad. I was never prepared for fighting over who wants to be the next millionaire. All I say to these lawyers is speed a week in Afghanistan, front lines, or a day at a mass grave site. Than perhaps they would understand that this is not a game. They were not there when we injured ourselves, they don't see the pain our wives, husbands and children go through and still the bicker about $$$$$$. My wife cries almost, does the law firm see this? My kids miss a father, does the law firm see this? Suicide attempts, did the law firm see those? No the law firm had seen an opportunity and took advantage of it. Bless them for doing what they had set out to do, however don't be fooled, it was not out of their bleeding hearts. They have indeed changed lives for the better.
